As part of our 25th Anniversary celebration the Federalist Society presented a full-day Conference on June 26, 2007, honoring Judge Robert H. Bork and his contributions to the law. In The Antitrust Paradox: A Policy at War with Itself, Judge Bork maintained that antitrust enforcement had overzealously applied the law in a manner that led to the protection of inefficient firms and the sanctioning of efficient firms, to the ultimate detriment of consumers. This form of interference in the free market, he argued, raised consumer prices by supporting flagging companies in order to maintain the perception of competition. How have Judge Bork's insights informed antitrust law and enforcement over the past 25 years? Have Judge Bork's views changed the approach utilized by courts in antitrust litigation? Oct. 21 (Bloomberg) -- US Senator Orrin Hatch, a Utah Republican, talks with Bloomberg's Carol Massar and Matt Miller about his request that President Obama have the Justice Department investigate college football's Bowl Championship Series. In a letter to the president yesterday, Hatch said a strong case can be made that the Bowl Championship Series violates the Sherman Antitrust Act because the BCS system amounts to restraint of trade. Congressman Lungren addresses the House of Representatives regarding the repeal of anti-trust immunity for the health insurance industry under the McCarron-Ferguson Act of 1945 and Lungren's amendment to the bill. Using bipartisan language from former Judiciary Chairman Jack Brooks (D-TX), Lungrens amendment was passed out of the House Judiciary Committee with unanimous consent. However, Rep. Lungrens amendment was stripped from the legislation by the House Leadership and the Rules Committee refused to allow the Lungren amendment to be debated on the House Floor. In this video, Rep. Lungren discusses the importance of his amendment for ensuring that the health insurance industry does not become even further concentrated and the bipartisan support for the amendment.
